1. SCOPE OF TERMS & CONDITIONS OF USE

1.1 These Terms & conditions of use regulate the use that can be made of the site www.lepaysdeslacs.be (hereafter the "Site"), its content and the information collected there. They apply to any booking of tourist services/products carried out by the user, from the Site, with a partner provider.

1.2 Any use of the Site is subject to the acceptance and compliance with these Terms & conditions of use.

1.3 They are proposed in French language and foreign languages (English, Dutch).

1.4 These Terms & conditions  are subject to change at any time. In case of modification,The version of the Terms & Conditions on the Site at the time of final confirmation of the booking by the User will be applied to the booking of tourism services/products.

1.5 The Terms & Conditions of use are available at any time from any webpage of the Site. The user can keep them by saving them on the hard disc of his computer or on any durable medium or by printing them on paper to refer to them at all times. This preservation is his sole responsibility.

1.6 The User's attention is drawn to the fact that tourism services/products booked via the Site are subject, in addition to these Terms & Conditions of use, to the sale Terms & Conditions of the partners Providers of the booked services/products.

1.7 The Sale Terms & Conditions specific to each partner service provider are accessible via a hyperlink displayed during the booking process, as well as in the booking confirmation e-mail once payment was made.

2. ACCEPTANCE

2.1 Any bookings made and paid via the Site is subject to prior cognisance and acceptance in full by the User by checking the box provided for this purpose, to these Terms & Conditions of use and the Sale Terms & Conditions of the partner provider of the desired product/service.

2.2 Without this acceptance, the continuation of the booking process is technically impossible.

3. OBJECT and DESCRIPTION of WEB SITE 'www.lepaysdeslacs.be '.

3.1 The booking Site www.lepaysdeslacs.be is published by the non-profit Association "Maison du Tourisme Pays des Lacs", abbreviated 'MTPL' with registered office at Route de la Plate Taille, 99, in 6440 Boussu-lez-Walcourt– Belgium, registered at the BCE.

3.2 Through the Site www.lepaysdeslacs.be, the "Maison du Tourisme Pays des Lacs" provides a platform for online booking of tourism services/products (tickets in some museums and other tourist sights and attractions, accommodation, packages including tickets, accommodation...), proposed and marketed to Users of the Site by partner providers.

3.3 It is a " tourist market place “ managed through systems of bridges of communication and 'Open System' technology, developed by the French Joint stock company 'ALLIANCE RESEAUX’ (with registered office at Rue Saint Exupéry, 26 in 73300 SaintJean-de-Maurienne – France, registered at the registry of the Trade Tribunal of CHAMBÉRY under the number 393953278).

3.4. The Site is intended to be an instrument of general interest made available to Partner providers to enable them to distribute and sell their tourism services/products for accommodation and leisure activities available in real time.

3.5 Tourism services/products offered by our partners on the Site are exclusively supplied and managed by and under the responsibility of said partners in accordance with their own Terms & Conditions of sale. It therefore is the responsibility of the user to acknowledge the Terms & Conditions of sale of each partner provider of the desired services/products, and, before any final booking on the Site.

3.6 The "Maison du Tourisme Pays des Lacs" distributes tourism services/products on its Site only as an intermediary between the user of the Site and the partner provider. However, by booking through www.lepaysdeslacs.be the user commits to a direct contractual relationship with the partner provider concerned by the booking.

3.7 However, occasionally, it is possible that the "Maison du Tourisme Pays des Lacsoffers on the Site, to users, in its name and on its own behalf, packages including various tourism products and/or services (museum tickets, accommodation services, catering...).

3.8 In this case, the packages offered by the "Maison du Tourisme Pays des Lacs" on the Site are exclusively supplied and managed by them and under their sole responsibility. They are therefore subject, in addition to the terms & conditions of use, the terms & conditions of sale of the "Maison du Tourisme Pays des Lacs" applicable to the package proposed, and available on the Site.

3.9 It should be noted that in the latter case, the "Maison du Tourisme Pays des Lacs" contracts directly with the user. However, it is directly to the latter the user must apply for any issue or complaint about his booking, or for any request for modification or cancellation of his booking according to the instructions and conditions indicated in the Terms & conditions of sale of the Lacs de l’Eau d’Heure specific to the package concerned. 

3.10The tourism services/products offered on the Site are only available for private use and are not intended for commercial use in connection with a commercial or competitive activity or purpose.

4. CONTRACT PROCESS APPLICABLE TO ANY LL TOURISM SERVICES/PRODUCTS ONLINE

4.1The user of the Site, who books / buys any tourism service and product, must be at least 18 years old, be legally able to enter a contract alone  and use the Site in accordance with the Terms & conditions of use applicable at the time of the final confirmation of the booking.

4.2 The online booking process on the Site includes four steps, namely:
-step 1: via the tab 'add to shopping trolley’, selection by the user of the services/products desired to place them in their trolley.
-step 2: once the shopping trolley’s content is final,  the user completes personal information in the required fields of the booking form (name, first name, address...) and validation of the information entered;
-step 3: unconditional acceptance by the user of these terms & conditions of use of the Site and the terms & conditions of sale specific to each booked service/product;
-step 4: final validation of the booking by the user after entering and confirming the bank account details for the purpose of payment of the full price due through the secure online payment system set up on the Site.

4.3 The user's attention is drawn to the fact that personal information provided by him in the online booking form, as well as their bank account details (only for hotels), are passed to the provider concerned by the booking.

4.4 At the end of the fourth step in the process of contracting online, the booking made by the user becomes final, under the suspensive condition of confirmation by the relevant Provider of desired availability.

4.5 The availabilities of the Provider are displayed in real time on the Site based on the information provided by the Provider. However, they have only an indicative value in view of  transactions that may be executed simultaneously via different marketing channels (websites, phone, email). In case of double booking, the Provider concerned will be responsible of contacting the user to resolve the problem amicably, or even refunding the user.

4.6 The provider of the booked service/product then addresses (automatically via the Open System) the user a confirmation email containing the services booked (in the body of the email or in annex), the price paid, the address of the user, as well as special conditions, specific to the Provider and the booking, in which it is possible for the user to modify or cancel the booking. 

4.7 The booking confirmation email is sent by the Provider (automatically via the Open System) to the e-mail address provided by the user in the booking form. It is therefore the responsibility of the User to ensure the data communicated when booking are accurate.

4.8 If the user does not receive an e-mail confirmation of their booking, it is incumbent to him to make direct contact with the provider concerned.

5. ABSENCE OF RIGHT OF WITHDRAWAL

5.1 In accordance with article VI.53 of the Economic Law Code, the user has no right of withdrawal when booking online for "accommodation services (other than for residential purposes), transport, car hire, catering or leisure activities-related services", whether booked jointly on the Site as a tourist package or separately for a date or at a specific frequency.

6. MODIFICATION OR CANCELLATION OF BOOKING

6.1 Any booking made on the Site, once confirmed, cannot be changed online later by the User, hence the importance for him to check, before any final confirmation that the information he provides is accurate and complete.

6.2 Requests for modification must be sent directly to the Partner provider concerned in accordance with the instructions given in the booking confirmation email. The change request will be processed by the Partner provider according to its own Terms & conditions of sale, to which the "Maison du Tourisme Pays des Lacs" is a third party.

6.3 In principle, the user also has the right to cancel a booking made on the Site. The cancellation must be done with the provider in a timely manner and according to the terms and conditions laid down in the Terms & conditions of sale of the partner provider concerned, as accepted by the user during the process of booking on the Site and to which the "Maison du Tourisme Pays des Lacs" is third party.

6.4 Any refund of sums paid by the user on the Site during the booking, which would be due to him following a cancellation or amendment of his booking, is the responsibility of the partner provider concerned according to its Terms & conditions of sale, without intervention or any liability of the  responsibility none of the "Maison du Tourisme Pays des Lacs".

6.5 The user is also informed that the cancellation of a booking can incur charges according to the Terms & conditions of sale applied by the Provider. It is also possible that in some cases (special offers, package, promotion...), the User cannot claim repayment of the sums paid on the Site from the partner provider concerned in the event of cancellation of the booking. 

6.6 It is therefore up to the user to achnowledge the Terms & conditions of sale of the partner provider concerned, in addition to the Terms & conditions of use, before booking. As a reminder, by booking, the user is prompted, during the booking process, to read these Terms & conditions of use and the Terms & conditions of sale of the Provider concerned, and to accept them by ticking the corresponding box, otherwise the booking process cannot be continued.

7. RATES

7.1 The rates for the services and products offered on the Site are quoted in euros and are all taxes included (TTC), unless expressly otherwise displayed on the Site or in the booking confirmation email.

7.2 Rates displayed on the Site are those charged by partner providers on various marketing channels (except occasional promotions offered online by the Provider in a particular action).

7.3 Rates are subject to possible changes by Partner providers. They are updated on the Site as changes in rates practised by Partner providers occur.

7.4 In any case, the rates charged to the user are those charged by the partner provider at the date of the final confirmation of booking by the user on the Site.

7.5 Any special/promotional offers are indicated as such.

8. PAYMENT

8.1 The payment of the total price of the services is carried out online to the "Maison du Tourisme Pays des Lacs", at the time of booking (step 4 of the booking process), by bank card, through the  secure payment system in place on the Site.

8.2 That online payment system allows to manage the additional sale of several products/services from different providers into a single payment, then redistributed by the "Maison du Tourisme Pays des Lacs", by digital transfer (SEPA) into the bank account of each provider.

8.3 Any changes made by the user to his booking, after final validation on the Site (number of persons, complementary service...), resulting in a price supplement or additional expenses for the user, should be settled directly by the latter to the provider concerned.

8.4 As a reminder, any potential refund of the price paid on the Site by the user is made directly by the provider concerned by the booking, according to its own Terms & conditions of sale.

9. RESPONSIBILITY OF THE "MAISON DU TOURISME PAYS DES LACS"

9.1 As stated above in section 3.6, the "Maison du Tourisme Pays des Lacsplays only the role of intermediary between the user and the provider. However, the "Maison du Tourisme Pays des Lacs" shall not be liable for any damages caused to the user resulting directly or indirectly:
- from total or partial breach of contract concluded directly between the user and the provider, in which the "Maison du Tourisme Pays des Lacs"is third party;
- from any incorrect, inaccurate or incomplete information relating to the service/product proposed by the provider concerned and indicated on the Site.
It is important to point out that the information provided by the "Maison du Tourisme Pays des Lacs" website relies on that communicated by the Providers. Only the provider of the service/product is responsible for the accurate, complete, up-to-date and accurate information about him and displayed on the Site, including its rates and availabilities.

9.2 The "Maison du Tourisme Pays des Lacs" may also not be held liable for damages of any kind caused to the user and which may arise, directly or indirectly, due to a temporary unavailability of the Site (due to a technical failure, an update...) or a connection problem to the Site, occurring during the booking process.

9.3 The "Maison du Tourisme Pays des Lacscannot also be held liable either for any damages caused to the user resulting directly or indirectly from mistakes that the user would have made when entering the personal information requested in the booking form, or fraudulent use by a third party of his credit card.

9.4 The "Maison du Tourisme Pays des Lacs" doesn't accept any commitment to the users of the Site about the quality of tourism services/products sold on the Site by them on behalf of partner providers.

9.5 The links implemented to other sites cannot engage the responsibility of the"Maison du Tourisme Pays des Lacs", as they do not exercise any control over the content of these sites. Consequently, the "Maison du Tourisme Pays des Lacs" cannot be held liable for the content, advertising, products, services or any other tool available from such external sites or resources that it has neither verified nor approved, nor be held liable for any consequential or connected damages from the use of these links.

10. INTELLECTUAL PROPERTY

10.1 The website and all its components (information, presentation of the Site, infrastructure, logos, texts, graphics, photos, images, illustrations, software...) are the exclusive property of the "Maison du Tourisme Pays des Lacs" and/or its content providers, licensors of the operating licences of software used by the Site, partners and tourism stakeholders.

10.2. It is forbidden to the user of the Site to reproduce, modify, take advantage of, incorporate or use in any manner whatsoever, all or part of the content of the Site and the information collected without the express prior written approval of the"Maison du Tourisme Pays des Lacs"

11. NULLITY

11.1 If any provision of these terms & conditions of use is declared unenforceable or invalid, whether in whole or in part, the relevant provision shall be deemed not to be an integral part of the terms & conditions of use. The validity and execution of other parts of the Terms & conditions of use are in no way affected.

11.2 In addition, the provision declared void or unenforceable will be replaced, if applicable with retroactive effect to the date of the entry into force of the contract concluded online, by another provision, valid and enforceable, whose legal effects will be as close as possible to the unenforceable or invalid provision.

12. APPLICABLE LAW AND DISPUTE (S)

12.1 These terms & conditions of use and the provision of our services are exclusively governed and interpreted in accordance with Belgian law.

12.2 Any issues and/or disputes resulting from the provision of our services and/or related to the validity, interpretation or execution of the present terms & conditions of use, will be subject to the exclusive competence of the courts of the judicial arrondissement of Charleroi.
